Article 2 — Applicability
These general terms and conditions apply to every offer made by Charlis and to every distance contract concluded between the company and the consumer.
By placing an order, the consumer agrees to these general terms and conditions.
Article 3 — The offer
The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Article 4 — The agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set forth therein.
Article 5 — Prices and payment
The prices stated include VAT and exclude shipping costs, unless otherwise stated. Payment is made via the payment options offered on the webshop.
Article 6 — Delivery and execution
Delivery within Belgium takes place via Bpost or for the Netherlands via PostNL or another logistics partner to the address or collection point specified by the consumer.
Jewels by Charlis is not liable for delays in delivery due to force majeure or incorrect data provided by the consumer.
Delivery times:

Belgium: 1-2 business days after dispatch

Netherlands: 2-4 business days after dispatch
Shipping costs are stated with the order and are according to the applicable postal rates of Bpost and PostNL or other carrier.
Charlis is not liable for delays with the carrier.
Article 7 — Right of withdrawal
The consumer has the right to withdraw from the contract within a period of 14 calendar days after the day of receipt of the product, without giving any reason.
To exercise the right of withdrawal, the consumer must inform us within this period via an unequivocal statement by e-mail at info@jewelsbycharlis.
The consumer must return the goods within 14 days after notification of withdrawal to:

The direct costs of returning the goods are for the account of the consumer, always with a package with track & trace so that the shipment can be followed by both parties.
In the event of a valid withdrawal, the returned items will be reimbursed via a credit note or refund by mutual agreement, within 14 days after receipt of the withdrawal notification.
Charlis may wait with repayment until the goods are back in its possession.
Exceptions to the right of withdrawal:
The right of withdrawal does not apply to:

custom-made or personalized articles.
Article 8 — Non-collection of an order
If a package is not collected in time at the collection point chosen by the consumer and is therefore automatically returned to Charlis, the sales agreement remains valid.
The purchase is not automatically canceled and the shipping costs are not refunded.
At the consumer's request, the order can be reshipped, subject to prior payment of the additional shipping costs.
If the consumer waives reshipment and requests a refund, this is only possible with the express consent of Charlis and outside the legal right of withdrawal.
In that case, Charlis reserves the right to charge an administrative fee of €15 for the processing and administrative handling of the return package and the refund.
If outside the withdrawal period, Charlis may refuse the refund or credit note and the package remains the property of the consumer and can be sent at a later date, provided that the shipping costs are repaid.
Optional:
In the event of a valid withdrawal, the consumer can voluntarily choose a credit note instead of a refund. This voucher is valid for 1 year and can be used for all purchases via the webshop.
Article 9 — Complaints procedure
All items are checked for any defects before delivery. If a defect is found, the purchase will be refunded if the item can no longer be supplemented from the supplier's stock or if, after consultation with the customer, it is exchanged for another item. Any visible damage or defects must be reported by e-mail to info@jewelsbycharlis. within 48 hours after receipt of the order, together with clear photos of the product and packaging. The time of receipt can always be checked by us using the track and trace code of the post office. If we receive notification of an error later than 48 hours after receipt, we are no longer responsible for any damage to articles.
Article 10 — Disputes
Belgian law applies exclusively to all agreements between Charlis and the consumer.
In the event of any disputes, only the courts of the district of Charlis' registered office have jurisdiction.
🧾 Policy against abuse and fraudulent orders
We attach great importance to a fair and secure webshop experience.
To prevent abuse, fake orders and disruptive behavior, the following provisions apply:

Validity of orders
An order is only valid after payment has been completed successfully.
Orders for which no (or a failed) payment has been received will be automatically canceled and the reserved stock will be released again. -
Abuse and fraud prevention
Our webshop automatically checks orders for irregularities and suspicious patterns.
In case of suspicion of abuse, repeated fake orders or deliberately disruptive behavior, we reserve the right to:-
Refuse or cancel orders;

Block customer accounts, email addresses or IP addresses;

Log technical data (such as IP address and time) for security purposes;

And, if necessary, share this data with our payment provider or competent authorities.

Repeated or intentional abuse
If it appears that someone deliberately places orders without the intention of payment, to cause damage or to hinder the operation of the webshop, we may report this to the police or other competent authorities.
In serious cases, we reserve the right to take legal action for nuisance or damage to our company. -
Privacy and data protection
All collected data is used exclusively to prevent fraud and abuse.
We handle this information carefully, in accordance with applicable privacy legislation (AVG/GDPR).
